Ohio Injured Workers' Rights
Injured workers have the right to choose chiropractic care
1. An Ohio injured worker has the right to choose a physician of his/her choice, to include Doctors of Chiropractic, Osteopathy, or Medicine.
2. The injured worker may require supportive care to maintain maximum medical improvement (MMI) once functional improvement has plateaued.
This means that occasional ongoing treatment should be approved if it helps keep the injured worker performing work duties and daily activities.
3. Your employer may direct you to a facility of its choice; however, you have the right to visit any BWC certified provider.
4. The injured worker has the right to change his/her treating physician at any point in time.
5. The injured worker has the first right to file a claim for an injury sustained during the course of and arising out of his/her work duties/employment.
6. The injured worker has the right to have all health care services relating to his/her work injury paid in full.
7. The injured worker has the right to be compensated for any missed/lost time at work as defined by Ohio law.
8. The injured worker has the right to file a Workers' Compensation claim without the fear of retribution or discrimination.
9. The injured worker has the right to appeal and follow due process for any and all managed care decisions affecting his/her choice of care.
10. The injured worker has the right to seek legal counsel for representation on her/his behalf.
11. The injured worker has the right to participate or not participate in any/all rehabilitation programs available through the Workers' Compensation system.
12. The injured worker has the right to a quality independent medical examination when required in his/her claim.
